What Constitutes a Wrongful Death?

Wrongful death involves a negligent, reckless, criminal, or intentional act that causes another person’s death. For example, suppose an intoxicated driver crashed into your loved one’s car, causing his or her death. In that case, you may be able to bring a wrongful death lawsuit against the intoxicated driver when there is reason to believe that a certain person or business caused your loved one’s death, either intentionally or negligently. It is worth taking the time to speak with a wrongful death lawyer. Courts hear wrongful death claims on the same grounds as personal injury claims, except in wrongful death cases, the victim did not survive his or her personal injuries. George’s Wrongful Death Act is the law that governs wrongful death lawsuits. Under the Wrongful Death Act, a plaintiff can bring wrongful death lawsuits for all of the following types of causes of action:

  • Medical malpractice, including medication areas, misdiagnosis, medical injuries, and surgical errors
  • Criminal actions that result in someone’s death, such as intentional homicide and manslaughter
  • Product liability lawsuits involving defective consumer products, a failure to warn customers of the dangers of a product, and defective manufacturing
  • Death caused by nursing home neglect or abuse
  • Death caused by someone driving under the influence of illegal drugs or alcohol
  • Death caused by sanitation issues or contaminated food in commercial establishments
  • Deaths caused by pedestrian accidents
  • Deaths caused when a bartender continues to serve alcoholic beverages to a person who is visibly intoxicated
  • Faulty engineering and construction malpractice

Who Can Bring a Wrongful Death Lawsuit?

Only certain individuals can bring a wrongful death lawsuit; only the following relatives of the deceased individual have a right to file a wrongful death claim:

  • Spouse
  • Adult child
  • Parent
  • A personal representative of the estate

Suppose you are considering bringing a wrongful death lawsuit against the person or company whose negligence caused your loved one’s death. In that case, we recommend speaking to a lawyer as soon as possible. Plaintiffs have two years from the date of their loved one’s death to bring a wrongful death lawsuit. There are a few exceptions to this rule. When there is a criminal case associated with your loved one’s death, you will have more time to bring a wrongful death lawsuit in civil court. The statute of limitations pause has until the criminal charges are resolved. However, in most cases, if you miss the deadline, you will not be able to bring a wrongful death lawsuit.

Damages Available in a Wrongful Death Lawsuit

Successful wrongful death plaintiffs can recover damages for “the full value of the life of the decedent without deducting for any necessary or personal expenses of the decedent had he or she lived.” These damages include compensation to cover the tangible and intangible losses that the deceased individual’s family has suffered. Damages available in a wrongful death lawsuit include funeral and medical expenses, and you loved one’s lost wages, including what he or she would have earned if not for the untimely death. You can also recover compensation for a loss of companionship and care, and compensation for your loved one’s pain and suffering up until the date of his or her death. In some cases, families can seek punitive damages when the defendant was grossly negligent or indifferent to others’ welfare.
